About Personal Injury Claims
If the treatment you received at the hands of a healthcare provider caused you pain and suffering, or had a negative effect on your health, you may have a case for making a claim for compensation.
Hundreds of thousands of people every year suffer injuries through no fault of their own. This may be due to a third party’s negligence, failing in their duty of care or driving without due care and attention.
Abbleys’ legal team will look at the circumstances of your accident, who is at fault and whether you have a case for being compensated. This may be because you have been unable to work, have suffered one or more injuries or needed specialist care or equipment during your recovery. FAQs
Your Questions Answered.
We’ve answered some of our most Frequently Asked Questions below. However, if you have a question that is not covered here, please feel free to speak to one of our experts. You can do this on 0161 200 9964 or via email at admin@abbleys.co.uk.
Will I be eligible to make a claim for personal injury?
You may be eligible to make a claim for compensation, providing you satisfy three main criteria:
- You were owed, or subject to, a duty of care by a third party;
- That duty was breached by the third party;
- You suffered an injury as a consequence
What is the time limit for making a claim?
Normally the maximum time for claiming for your injuries is three years from the date of the accident. Certain circumstances may apply, so if you are unsure, contact our legal experts by calling 0161 200 9964 or via email at admin@abbleys.co.uk.
What would a compensation payment cover and how would the amounts be calculated?
Any award made to you by the defendant may consider a range of damages such as medical expenses, travel costs, loss of earnings, extra care and assistance you may have required (such as at-home nursing), ongoing treatment, medical equipment and prescription charges. It is difficult to make estimates without knowing the extent of injuries sustained. Generally, the amount awarded as compensation is loosely based on the severity and permanence (or time it takes to make a full recovery) of the injury, and if you have had to make any lifestyle changes because of your injuries.
Can I claim for more than one injury?
Yes, if you suffered multiple injuries in the same accident you can make a claim for each.
What evidence do I need to back up my personal injury claim?
Being able to present evidence for your claim is a vital part of making a successful claim. Firstly you will need to document your injuries with medical records, which will establish a link between your injuries and the accident that caused them. It may also be helpful to provide accident reports that establish the circumstances of the incident, and therefore liability.
You may wish to consider submitting proof that your claim is a credible one, such as photographic evidence or statements from any witnesses. Finally, if you are claiming for any financial losses you have suffered you will require records of any expenses incurred (medical bills, loss of earnings, equipment purchased, care costs and more) to help in calculating any amount you may be paid.
How much will it cost?
Our work is carried out using contingent fee agreements. This means that our fees are linked to your success and the compensation you are awarded, so there are virtually no circumstances under which you will pay our legal fees without winning your claim. All we ask is that you cooperate fully with our legal experts by being completely honest with us and providing timely responses to any queries or requests we put to you.
How can I be sure that the accident was someone else’s fault?
If you were injured in an accident and it wasn’t your fault, it may be that the fault lies with someone else and you will be eligible to make a claim for compensation. Where the responsibility lies will often depend on how and where it occurred, and exactly what caused the incident, so you should consult our legal experts who will examine the circumstances of your accident.
Common causes of accidents in which a third party is responsible include (but are not limited to):
- when someone’s careless driving caused you (as another driver, a passenger or a pedestrian) to suffer injury;
- when your employer’s breach of their duty of care resulted in you having an accident at work;
- when you had your accident in a business or in a building with public access, meaning the business or building’s owners have responsibility;
- when you were injured in a public area that has not been properly maintained by the authorities, such as the local council.
How long will my claim take to complete?
The length of time any personal injury claim will take will vary from case to case. The first thing to consider is the complexity and/or severity of your injuries and the circumstances under which they were sustained. We will also need time to gather all the evidence, which can impact the time required to settle your case. Should we need to issue court proceedings against the defendant this can also delay your claim. We will always act in your best interests to achieve a settlement for you as soon as possible but we will endeavour to keep you updated throughout the process.
